Boatsmart Transport - Terms
1. Definitions
- “Company” refers to Boatsmart.
- “Customer” refers to the person or business engaging the Company.
- “Goods” refers to the boat, trailer, or associated equipment to be transported.
- “Services” refers to transport, collection, delivery, lifting, or related logistics provided by the Company.
2. Quotations & Booking
2.1 All quotations are based strictly on the information provided by the Customer.
2.2 Quotations are valid for 14 days unless otherwise stated.
2.3 A booking is only confirmed once accepted in writing (including email or message) and any required deposit is paid.
2.4 The Company reserves the right to revise pricing if material details change.
3. Customer Responsibilities
3.1 The Customer must provide accurate and complete information, including but not limited to:
- Boat weight (fully loaded, including fuel, gear, and water)
- Length, beam, and height
- Trailer condition and roadworthiness
- Access conditions at collection and delivery points
3.2 The Customer must ensure:
- The Goods are safe and legal to transport
- Any trailer is roadworthy and compliant with UK law
- Clear and safe access is available for loading and unloading
3.3 The Customer is responsible for any additional costs or failed service resulting from inaccurate or incomplete information.
3.4 The Customer warrants that the declared weight of the vessel is accurate within ±10%. Any variance beyond this may result in immediate termination of the job, with full charges payable.
4. Right to Refuse or Abort Service
4.1 The Company reserves the right to refuse or abort a job on arrival if:
- The Goods differ materially from the description provided
- The weight exceeds legal or safe towing limits
- The trailer is unsafe or unroadworthy
- Access conditions make the job unsafe or impractical
4.2 In such cases, the job will be deemed aborted due to Customer default, and charges will apply under Section 8.
5. Pricing & Additional Charges
5.1 Prices are based on:
- Distance
- Time
- Complexity
- Declared specifications of the Goods
5.2 Additional charges may apply for:
- Waiting time beyond agreed allowance
- Difficult access or delays
- Incorrect information provided
- Additional equipment or labour required
5.3 Any additional charges will be communicated where reasonably possible.
6. Cancellations
6.1 Cancellation must be made in writing.
6.2 Cancellation charges:
- More than 48 hours before booking: No charge or full refund of deposit
- 24–48 hours before booking: 50% of agreed price
- Less than 24 hours: 100% of agreed price
6.3 If the Company has already commenced travel, full charges apply regardless of notice period.
7. Failed Collections / Abortive Visits
7.1 A failed collection includes (but is not limited to):
- Incorrect weight or dimensions supplied
- Unsafe or unsuitable trailer
- Inaccessible location
- Boat not ready for collection
7.2 In such cases, the Customer will be liable for:
- Full travel costs (both directions)
- Time spent
- Any accommodation or additional expenses if applicable
7.3 Minimum charge for failed collection: 100% of quoted job price or actual incurred cost (whichever is greater).
8. Refund Policy
8.1 Refunds are only applicable where:
- The Company cancels the job (excluding force majeure)
- Both parties agree in writing
8.2 No refunds will be issued where:
- The job cannot proceed due to Customer error or misinformation
- The Customer cancels within 24 hours
- A failed collection occurs
9. Delays & Force Majeure
9.1 The Company is not liable for delays caused by:
- Traffic or road conditions
- Weather
- Mechanical issues beyond reasonable control
- Acts of God or unforeseen events
9.2 In such cases, the Company will make reasonable efforts to complete the service but cannot guarantee timing.
10. Liability
10.1 The Company will exercise reasonable care and skill in providing services.
10.2 Liability is limited to:
- Direct loss or damage caused by proven negligence
10.3 The Company is not liable for:
- Pre-existing damage
- Mechanical or trailer failure
- Losses due to delays
- Consequential or indirect losses
10.4 The Customer is responsible for ensuring adequate insurance for the Goods.
11. Payment Terms
11.1 Payment terms will be agreed prior to booking.
11.2 The Company reserves the right to require:
- Full payment in advance
- Or deposit plus balance before delivery
11.3 Late payments may incur interest and recovery costs.
12. Termination
12.1 The Company may terminate a booking immediately if:
- The Customer provides false or misleading information
- Safety is compromised
- Legal compliance is at risk
12.2 In such cases, all applicable charges remain payable.
13. Complaints
13.1 Any complaints must be submitted in writing within 7 days of service.
13.2 The Company will investigate and respond within a reasonable timeframe.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
15. Acceptance
By confirming a booking, the Customer acknowledges and agrees to these Terms of Business.
